Rental Dwelling Insurance in Texas: What Landlords Must Know

October 20, 2026

What rental dwelling insurance in Texas actually covers

If you own a house, duplex, or small apartment building that you rent out to tenants, a standard homeowners policy will not protect you. Carriers write homeowners policies for owner-occupied homes. The moment you hand over keys to a paying tenant, you have a different exposure, and you need rental dwelling insurance in Texas to match it. This post explains what that coverage does, what it does not do, and how to structure a policy so you are not caught short when something goes wrong.

The core coverage parts of a rental dwelling policy

A rental dwelling policy (sometimes called a DP-3, or dwelling fire form 3) is built around three primary coverage parts:

  • Dwelling coverage pays to repair or rebuild the physical structure after a covered loss such as fire, windstorm, hail, or a burst pipe. In Texas, where hailstorms are common from Central Texas up through the Hill Country, this is the coverage that matters most.
  • Other structures covers detached garages, fences, storage sheds, and carports on the property. This is typically set at 10 percent of your dwelling limit.
  • Liability coverage pays for bodily injury or property damage claims made against you as the landlord. If a tenant trips on a loose step and sues you, liability coverage responds.

Most landlords also add loss of rents (or fair rental value) coverage. If a fire makes the property uninhabitable, this pays you the rent you would have collected while repairs are made. Without it, you absorb the mortgage payment and repair costs at the same time.

How rental dwelling insurance differs from a standard homeowners policy

This distinction trips up a lot of first-time landlords, especially people who inherited a home or bought a second property and simply started renting it out. The differences matter financially.

  • Occupancy requirement: homeowners policies (HO-3) require the named insured to live in the home. If a carrier discovers you are renting the property out, they can deny a claim or cancel the policy entirely.
  • Personal property: a homeowners policy covers your belongings inside the home. A rental dwelling policy does not cover a tenant's belongings (that is the tenant's responsibility through a renters policy), but it can cover items you leave at the property for maintenance use, like a lawnmower.
  • Vacancy provisions: rental properties sometimes sit empty between tenants. Rental dwelling forms have specific vacancy clauses you need to understand. If a property is vacant for 30 to 60 days (the exact threshold varies by carrier), certain coverages may suspend. Ask your agent how your policy handles vacancy periods.
  • Rating factors: carriers rate rental dwelling policies differently than homeowners. Tenant-occupied homes carry different risk profiles, and premiums reflect that.

Many landlords who come to us had no idea their homeowners policy was void the day they signed a lease with a tenant. Do not wait for a claim to find out.

Liability exposure landlords in Texas cannot ignore

Texas law does not require landlords to carry liability insurance, but the practical exposure is significant. A landlord can be held liable for injuries on the property when negligence is involved: a mold problem that was reported and ignored, a broken railing, a faulty electrical outlet. Medical bills and legal defense costs add up fast.

Most rental dwelling policies include $100,000 to $300,000 in personal liability coverage as a baseline. For landlords with multiple units or higher-value properties, that limit may not be enough. A personal umbrella policy can extend your liability protection by $1 million or more for a relatively modest additional premium. You can learn more about how umbrella coverage layers on top of a base policy on our personal umbrella insurance page.

Landlords with commercial-scale operations (several units or an LLC holding the properties) may be better served by a commercial landlord insurance policy rather than a personal dwelling form. The right structure depends on how your properties are titled and how many units you own.

What rental dwelling insurance does not cover

Knowing the gaps is just as important as knowing what is included. Here are the common exclusions landlords run into:

  • Flood damage is excluded on virtually every rental dwelling policy in Texas. With Central Texas rivers like the Leon and the Little River prone to flash flooding, and FEMA flood maps that do not always reflect true risk, this gap matters. A separate flood policy through the National Flood Insurance Program (NFIP) or a private carrier covers flood damage to the structure.
  • Tenant's personal property is not covered by your policy. A tenant's furniture, electronics, and clothing are their own responsibility. Encourage (or require in the lease) that tenants carry their own renters insurance. We explain this in more detail for tenants in our post on why renters insurance is worth it in Texas.
  • Intentional damage by tenants is covered by some policies and excluded by others. If yours does not cover it, a landlord endorsement or a separate tenant-damage rider may be available. Ask specifically.
  • Wear and tear / deferred maintenance: no insurance policy covers gradual deterioration. Replacing an aging roof that leaked slowly over years is a maintenance cost, not an insurable loss.
  • Mold remediation is heavily restricted in Texas after years of large losses. Some carriers offer limited mold endorsements, but standard coverage will generally not pay for mold removal.
  • Business liability: if you manage properties as a business, a personal liability policy may not fully protect you against certain commercial-type claims. Talk to an agent about whether your setup calls for a commercial form.

Setting the right coverage limits for your rental property

The most common mistake landlords make is insuring to the market value of the property rather than the replacement cost . Market value includes the land, which can never burn down. Replacement cost is what it would actually cost to rebuild the structure from the ground up at today's labor and material prices.

In Texas, construction costs have risen sharply over the past several years. A home that sold for $180,000 might cost $220,000 or more to rebuild depending on square footage, materials, and local labor rates. If you insure to market value, you may be underinsured by tens of thousands of dollars.

When setting limits, work with your agent to get a replacement cost estimate. Many carriers have built-in cost estimator tools. Also confirm whether your policy pays claims on a replacement cost value (RCV) or actual cash value (ACV) basis. ACV deducts depreciation. A 15-year-old roof that costs $20,000 to replace might only pay out $8,000 on an ACV basis after depreciation. RCV coverage costs more in premium but pays the full rebuild cost.

Loss of rents: how much to carry

Loss of rents coverage is typically set as a percentage of the dwelling limit or as a flat dollar amount. A reasonable starting point is at least 12 months of gross rental income as your loss of rents limit. A major fire can take six months to a year to fully remediate and rebuild in Texas, depending on contractor availability and permitting timelines. If you run short on this coverage, you absorb mortgage costs out of pocket while the property sits uninhabitable.

Special considerations for Texas landlords

Texas has some unique factors that influence how you structure rental dwelling insurance coverage.

Hail and wind deductibles

Most Texas property policies carry a separate wind and hail deductible, expressed as a percentage of the insured value rather than a flat dollar amount. A 2 percent wind/hail deductible on a property insured for $200,000 means your out-of-pocket exposure for a hail claim is $4,000 before the policy pays anything. In Central Texas, where severe hailstorms are a regular spring and summer event, that number is important to understand before a storm hits.

Flood risk in Central Texas

Flash flooding is a genuine hazard across the areas Winkler Insurance Agency serves, including Temple, Killeen, Belton, and Waco. Even properties outside the 100-year floodplain can flood during extreme rain events. Our detailed guide on flood insurance in Central Texas covers how to assess your flood risk and what a separate flood policy costs.

Short-term rentals and vacation properties

If you rent through Airbnb or VRBO, even occasionally, a standard rental dwelling policy may not cover those stays. Short-term rental activity creates a different liability and property damage exposure. Some carriers offer short-term rental endorsements; others require a completely separate policy. Be specific with your agent about how you use the property.

Multiple rental properties

Landlords with two or more properties often find it more efficient and cost-effective to explore a commercial package policy or a portfolio approach through a single carrier rather than managing separate personal policies on each address. This can simplify billing, claims reporting, and coverage management.

How to get the right rental dwelling policy in Texas

Shopping for rental dwelling insurance on your own is harder than it looks. Not every carrier writes this line. Others write it but with restrictions on older homes, high-crime zip codes, or properties with deferred maintenance. As an independent agency, Winkler Insurance Agency works with multiple carriers and can compare options on your behalf rather than steering you toward a single company's product.

When you call or request a quote, have this information ready:

  • Property address and year built: age affects pricing and what carriers will write.
  • Square footage and construction type: frame, masonry, or masonry veneer affects the replacement cost estimate.
  • Roof age and material: a roof over 15 to 20 years old may limit your carrier options or result in an ACV settlement for roof claims.
  • Current lease status: occupied, vacant, or short-term rental determines which form applies.
  • Current rent amount: needed to size your loss of rents coverage correctly.
  • Any prior claims: carriers check claims history through CLUE reports, so disclose accurately.
